Police, in connection with a case in Crime No.102 of 2024, for the offence punishable under Section 174 of Cr.P.C altered into 306 IPC, has filed this petition seeking anticipatory bail.

2. The case of the prosecution is that the defacto complainant's sister, namely, Abinaya and the first petitioner had worked in A-to-Z Hospital, Tanjore and both had loved each other. After knowing about the love relationship between them, the Hospital Management had terminated them from the hospital. Thereafter, since the first petitioner has refused to marry the defacto complainant's sister, she gave a complaint before the Superintendent of Police Thanjavur on 20.03.2024 and she went to the petitioners' house to know the whereabouts of the first petitioner, at that time, the second petitioner, who is the father of the first petitioner, has refused to give the details of the first petitioner. Hence, she committed suicide.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He has been falsely roped into the offence since his son is arrayed as A1. This is the second petition for anticipatory bail. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the petitioner is the father of A1. A1 had some intimacy with the deceased and refused to marry her. Therefore, the deceased went to the house of the petitioner and informed the same to him. At that time, the petitioner also abetted the deceased to commit suicide.

5. Considering the facts and circumstances of the case and also considering nature of offence, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail in the event of his arrest or on his appearance within a period of fifteen days from the date of receipt of a copy of this order, before the concerned Judicial Magistrate on condition that (i) the petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Tanjavur.

(ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any 3/5

other identity card issued by the government in proof of their residence address; (iii) The petitioner shall appear before the respondent police on every Saturday at 10.30a.m., until further orders. The petitioner has to co-operate for the investigation. (iv) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses.
