O R D E R
The present Criminal Original Petition has been filed by the 1st accused in C.C.No.263 of 2024 on the file of learned Judicial Magistrate, Alangulam, Tenkasi District, seeking to quash the charge sheet, wherein the petitioner is charged with the offence under sections 465, 467, 468, 420 and 120(b) IPC.
2. A perusal of the charge sheet reveals that the petitioner along with the others have forged documents in relation to a Government property which is allotted to the Police Department and later made an attempt to alienate the same by creating power of attorney. 2/5
3. According to the learned counsel appearing for the petitioner, he was not shown as an accused in the FIR. He was implicated in view of the fact that he had sought certain information under the Right to Information Act from the Revenue officials. He further submitted that he is an uneducated person and he is neither a signatory nor an attestor of anyone of the documents.
4. Heard the learned counsel on either side and perused the material on records.
5. A perusal of the charge sheet clearly reveals that the petitioner along with others is said to have created certain documents to alienate the Government properties. Since specific over tact are alleged as against the petitioner herein, this Court is not inclined to entertain the present petition, especially in the light of the fact that no legal grounds have been raised. The presence of the petitioner shall be dispensed with unless specifically directed by the trial court. 3/5
6. There are no merits in this petition. Accordingly, the Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
