ORDER
(Order of the Court was made by T.S.SIVAGNANAM, J) Heard Mr.R.Yamuna, learned counsel appearing for the petitioner, Mr.A.K.Baskara Pandian, learned Special Government Pleader appearing for the respondents 1, 2, 4 and 5 and Mr.N.S.Karthikeyan, learned Standing Counsel appearing for the respondents 3 and 6.
2.This writ petition has been filed as "Public Interest Litigation" for issuance of Writ of Mandamus, directing the respondents to arrange roundana circle at Srirangam, Trivanaikovil Junction via., Mambala Salai to Kollidam State Highway Road by considering his representation.
3.The learned counsel for the petitioner has produced photographs to demonstrate as to whether the roads are narrow and when the traffic moves from the service road to the main road, there are accidents occurred on several times, since there is no roundana provided. It is not known as to why the representation given by the petitioner has not been taken note of. Though the Trichy Corporation was impleaded as a third respondent, the road falls within the purview of the State Highways Authority, Thiruchirappalli Division, the second respondent (as per amended cause title dated 08.04.2019). The State Highways Authority has not even sent any reply to the representation given by the people. As many as 33 people have signed the representation. A copy of the representation has also been sent to the Police authorities as well.
4.The rough sketch has been produced by the petitioner. From which, we find that there is likelihood of the accident occurring on account of traffic move from the service road towards Srirangam road. There is a four road junction. Hence, an appropriate action should be initiated by the second respondent, the State Highways Authority.
5.In the light of the above, we direct the second respondent to take note of the situation immediately and conduct an inspection along with officers and before doing so, the second respondent shall intimate the same to the Police Department so that the Police Officials will also be present and if consultation is required to be done with the officials of Trichy Corporation, the same shall be done. After examining all these aspects, appropriate action should 2/3
be initiated so that the public should not put in inconvenience and thereby, the accident would be prevented. The above direction will be complied with within a period of four weeks from the date of receipt of copy of this order.
6.With the above direction, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
