Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.B.MAHENDRARAJAN, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate (Criminal Side) on behalf of the Respondent, the court made the following order:- This Petition is filed to modify the condition in para No.6(iii) in Crl.O.P.(MD) 1/3
No.5882 of 2024 dated 17.04.2024 in connection with Crime No.57 of 2024 on the file of the respondent police.
2. The petitioner, a Block Development Officer, is said to have abused another Block Development Officer/defacto complainant over phone on 07.04.2024 and therefore, on the complaint of the defacto complainant, a case was registered in Crime No.57 of 2024, for the offence punishable under Sections 294(b) and 506(i) I.P.C.
3. This Court while considering the anticipatory bail for this petitioner imposed a condition that the petitioner shall appear before the respondent police for a period of three weeks. The petitioner has moved this application to modify the above condition on the ground that this petitioner was on election duty and the order copy was made ready only on 26.04.2024 and therefore, he could not comply with the condition. The Election in the State of Tamil Nadu took place as early as on 19.04.2024 and according to the petitioner, the order copy was made ready, on 26.04.2024.. This Court has already granted anticipatory bail and granted fifteen days time for furnishing sureties. The petitioner has not taken any steps to furnish sureties for the past one month and has not moved any application for extension of time. 2/3
