Respondents PRAYER: Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 26.07.2021 and 27.12.2021 for restoration of the lands in Survey Nos.15/A2, 15/B2 and 15/C2 with an extent of 2 acres 25 cents in the village of Kondanpethan, Madurai East Taluk, Madurai District to the petitioner and his brother by making necessary mutations in the revenue records.

Heard the learned counsel on either sides.
2. The petition mentioned lands were acquired some 25 years ago for public purpose.
3. The case of the petitioner is that the lands were never put to that purpose, for which, they were originally acquired. He therefore seeks restoration of the same. However, I cannot accept the said contention. As rightly pointed out by the learned Additional Government Pleader appearing for the respondents, once the lands have been acquired and vested with the Government, even if the lands have not been used for which they have been acquired, since the lands can be put into any other public purpose, the question of restoration does not arise at all. There is no merit in the Writ Petition.
