This Criminal Original Petition is filed seeking a direction to the learned Additional District Judge, Thoothukudi to expedite the trial in SC No.105 of 2019 in a efficacious manner. 1/4

2.On the side of the petitioner, it is stated that the occurrence is of the year 2009 and the case in SC No.105 of 2019 is pending even without examination of single witness. Hence, a suitable direction may be issued to the concerned Judge to dispose of the above case within the time limit. It is reported that the post of regular Judge is vacant and the learned II Additional District Judge, Thoothukudi is the incharge Judge of the Special Court. 3.On the side of the prosecution, it is stated that totally there are 23 witnesses and they are yet to be examined and all the witnesses could not be examined within a time frame. 4.Considering the submissions made on either side and taking into consideration of the fact that the case is of the year 2019, there shall be a direction to the Special Court and to the learned II Additional District Judge, Thoothukudi, who is incharge of the Special Court to dispose of the case in S.C.No.105 of 2019, on 2/4

merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order. Registry is directed to mark a copy of this order to the trial Court.

5. With the aforesaid directions, the Criminal Original Petition is disposed of.
