Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned Refusal Check Slip in Refusal No:RFL/Sanarpatti/65/2025, dated 23.07.2025 passed by the third respondent and quash the same as illegal, consequently, directing the third respondent to register the sale deed dated 22.01.2025 presented by the petitioner. 1/4

ORDER

The Writ Petition is filed challenging the impugned refusal check slip, dated 23.07.2025.

2. The claim of the petitioner is that one Chinnaraja and others are the original owners of the property. The petitioner purchased the property from them by a registered sale deed dated 27.09.1995. When the petitioner presented the sale deed for registration, the same was refused for registration.

3. Upon perusing the impugned refusal check slip, it can be seen that by stating that subsequently the very same property has been dealt with in the year 2000 by Document No.302 of 2000 by the very same Chinnaraja and others, the document is refused to be registered. On the face of it, even considering the double entry when the petitioner's sale deed is of the year 1995, the reasons mentioned in the refusal check slip cannot be sustained. 2/4

4. The learned Special Government Pleader appearing on behalf of the respondents could not state any other reason to support the impugned refusal check slip.

5. It is seen that the order has been passed suo-motu by the third respondent and there has not been any objection by any private parties. In view thereof, this Writ Petition is allowed on the following terms: (i) The impugned refusal check slip, dated 23.07.2025 shall stand quashed;

(ii) Within two weeks from the date of receipt of a web copy of the order, the petitioner shall represent the sale deed and the same shall be registered, if there is no other impediment. No costs.
