PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to reconstruct the temple by named "Arulmigu Mallendeswarar Temple (Temple No.TM032139)" and consequently seeking directing to the second to fifth respondents to conduct "Kudamuzhukku" in "Arulmigu Mallendeswarar Temple", situated in Meiyampatti Village, Natham Taluk, Dindigul District based on the petitioner's representation dated 11.03.2023, 30.10.2023 and 24.05.2024 within a time frame fixed by this Court. ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) The prayer sought for in this Writ Petition is for a Writ of Mandamus, to direct the respondents to reconstruct the temple by name "Arulmigu Mallendeswarar Temple (Temple No.TM032139)" and consequently seeking a direction to the respondents 2 to 5 to conduct "Kudamuzhukku" in "Arulmigu Mallendeswarar Temple", situated in Meiyampatti Village, Natham Taluk, Dindigul District, based on the petitioner's representation dated 11.03.2023, 30.10.2023 and 24.05.2024 within a time frame fixed by this Court.

2.Heard Mr.B.Vinoth Kumar, learned counsel appearing for the petitioner and Mr.P.Thilak Kumar, learned Government Pleader appearing for the respondents.

3.The learned Government Pleader appearing for the respondents has received written instructions from the Fit Person of the Temple concerned, dated 11.06.2024, where he has given the following instructions:

4.Relying upon this communication of the Fit Person of the Temple, the learned Government Pleader would submit that already the proposal has been shaped by preparing an estimate to the extent of 3/6

Rs.13,50,000/- for the reconstruction of the Temple called 'Arulmigu Mallendeswarar Temple' at Meiyampatti Village, Natham Taluk, Dindigul District and in this regard, palalayam has been proposed on 10.07.2024, for which approval has been sought for from the Commissioner of the Hindu Religious and Charitable Endowments Department. Once such approval is given, palalayam will be undertaken on 10.07.2024, thereafter, reconstruction work will be undertaken.

5.The said submission made by the learned Government Pleader appearing for the respondents relying upon the communication of the Fit Person of the Temple concerned, dated 11.06.2024, is taken on record. As the HR & CE Department has already taken action to reconstruct the Temple, for which, palalayam date also since has been fixed, no further order is required to be passed in this Writ Petition, as has been sought for. Hence, this Writ Petition, by recording the aforesaid development, is disposed of. However, there shall be no order as to costs.
