Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, for issuance of a Writ of Mandamus to direct the respondents 1 to 3 herein to remove the encroachments made by the respondents 4 to 9 in Vetri Oorani in S.No.393/3 in Vilangudi Village, Devakottai Taluk, Sivagangai District and to protect the said Oorani.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the present writ petition is to direct the respondents 1 to 3 to remove the encroachments.

2. The learned Government Pleader appearing for the respondents 1 to 3 would submit that the assignees of Government lands have encroached upon the land over and above their assignment. 2/4

3. The learned counsel appearing for the petitioner would submit that it is a water body which is under encroachment.

4. That being so, the authorities competent are to initiate action for eviction of encroachment from the water body by following the procedures as contemplated. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. The writ petition stands disposed of with the above observations. No costs.
