PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, calling for the records relating to impugned proceedings in Na.Ka.No.21243/C3/E1/2023 dated 26.04.2023 of the respondents 2 and 4 herein and quash the same in so far as for conducting BT Assistant transfer counselling within a revenue district, one district to another district and deployment transfer counselling within revenue district to the BT Assistant Working in Government/Municipal Schools coming under the control of the 2nd respondent herein and consequently direct the respondents herein to conduct BRTEs conversion counselling for the academic year 2022-23 before the BT Assistant transfer counselling of the academic year 2022-2023 by filling up the 500 vacancies due to conversion of 500 BRTEs as BT Assistant in the academic year 2020-2021 as per the G.O.(1d) No.134, School Education(Pa.Ka. 5)(1) Department dated 18.08.2021 of the 1st respondent herein. The instant writ petition has been filed by a BRT Teacher, challenging the instructions issued by the second respondent herein for the transfer counselling for the year 2022-2023 for BT Assistant Teachers. 2.As could be seen from the records, the counselling for BT Assistant Teachers for the year 2022-2023 have been completed and therefore, the instructions would not survive beyond the said academic year. 2/5

3.According to the learned Counsel appearing for the writ petitioner, in case, if the State intends to conduct a fresh counselling for BT Assistant Teachers, it should be preceded by a counselling for converting BRT Teachers to BT Assistant Teachers. This request of the writ petitioner is premature at this point of time, in view of the submissions of the learned Additional Government Pleader appearing for the respondents, that as on today, they have no proposal for conducting any conversion counselling.

4.In case, if any new instructions are issued for conversion counselling, the petitioner is always at liberty to follow the said instructions or challenge the same, if she is so advised.

5.With the above observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 23.09.2024 8/10 NCC : Yes/No Index : Yes / No Internet : Yes / No RJR 3/5
