ORDER

The petitioner challenges the order of the first respondent in File No.2025/N103/24/006643, dated 04.04.2025.

2. The grievance of the petitioner is that the request for transfer of patta has been rejected without any notice to the petitioner or any enquiry being conducted as mandate under the Patta Passbook Act.

3. On this limited ground, I am inclined to interfere with the impugned order passed by the first respondent and hence, the impugned order is set aside and the matter is remitted to the first respondent for fresh consideration. The first respondent shall consider the petitioner's application for transfer of patta afresh, after giving notice to the petitioner and also fair opportunity to the petitioner and the third respondent for putting forth their respective claims and objections. The first respondent shall pass well reasoned orders after conducting the necessary enquiry, within a period of twelve weeks from the date of receipt of a copy of this order.

4. In the result, the writ petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No NCC : Yes / No 30.04.2025 am To
