Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, directing the respondents to consider the petitioner's "Aadhaar Enrolment/Correction/Update Form dated 08.02.2021" which has been acknowledged in UIDAI's Receipt No.2192/50457/27484 dated 08.02.2021" and the petitioner's representation dated 05.03.2021 and to alter the petitioner's Date of Birth (DOB) from 08.01.1955 to 10.02.1950 in the Aadhaar Card No.3758 6401 9253 within a time limit to be fixed by this Court.

ORDER

The petitioner seeks a direction to rectify the date of birth particulars in her Aadhaar Card.

2. The petitioner states that her husband, the late Mr.P.Balakrishnan, served in the Indian Army and retired therefrom. In the relevant pension payment order, her name is reflected as his 1/3

wife and the date of birth is correctly recorded as 10.02.1950. However, the Aadhaar card bearing No.3758 6401 9253, which was issued by the first respondent, wrongly specifies the date of birth as 08.01.1955. In order to rectify this mistake, the petitioner submitted the prescribed Aadhaar data update form on 08.02.2021. Several follow up steps were also taken on subsequent dates. Eventually, it is stated that the petitioner received the communication dated 02.12.2020 informing her that she is required to personally visit a permanent enrolment centre along with the Aadhaar letter and relevant documents as indicated therein. The present writ petition is filed in the said facts and circumstances.

3. Mrs.Victoria Gowri, learned ASGI, accepts notice on behalf of the respondents. She points out that the communication dated 02.12.2020 from UIDAI indicates all the valid documents for date of birth updation. It is evident from the said list that it also includes the Central/State pension payment order. Consequently, it appears that the petitioner has a valid document for purpose of updation or correction of the date of birth in the Aadhaar document. Learned ASGI also points out that it is necessary that the petitioner visits a permanent enrolment centre for purposes of such updation.

Accordingly, the respondents herein are directed to consider the petitioner's request for correction/updation of the Aadhaar card as regards her date of birth and to dispose of the same within a period of two months from the date of receipt of a copy of this order. For such purpose, the petitioner is directed to appear at a permanent enrolment centre of her choice.

5. W.P.(MD).No.13506 of 2021 is disposed of on these terms without any order as to costs.
