ORDER
The present Writ Petition has been filed challenging the impugned charge memo issued by the first respondent vide proceedings dated 21.11.2024 in Ref.No.E1/5136570/2023, whereby two charges were framed against the petitioner.
2. Heard the learned counsel for the petitioner in detail and perused the affidavit filed in support of this petition.
3. Though an attempt was made to contend that the charges framed against the petitioner and the criminal case pending against the petitioner arise out of the same facts and circumstances, no material has been placed before this Court to verify the same. All other submissions made before this court, as averred in the affidavit filed in support of the petition, are on the merits of the charges and contend that the charges are baseless and false.
4. In response to the charge memo, the petitioner has already submitted his explanation as early as on 06.02.2025, and the same is pending consideration before the first respondent.
5. On the other hand, Mr.K.K.Udayakumar, learned counsel for Government, on instructions, submitted that an Enquiry Officer had already been appointed on 07.11.2025 to enquire into the charges in question. The records have already been received from the Vigilance and Anti-Corruption Department. He further submitted that the entire enquiry proceedings will be completed expeditiously.
6. In light of the above, this Court finds no reason to interfere with the impugned charge memo at this stage. Accordingly, this Writ Petition is disposed of, directing the first and second respondents to ensure that the disciplinary proceedings initiated against the petitioner pursuant to the impugned charge memo are concluded as expeditiously as possible, at any rate within a period of four (4) months from the date of receipt of a copy of this order.
