Respondent(s) PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, call for the records relating to the impugned orders bearing Award No. 6/91-92-Plot No.33 to Plot No.40 dated 02.11.2011 (8 Orders) passed by the 5th respondent and quash the same and consequently direct the respondents 1 to 6 to retain the Open Vacant Space of about 40 cents available in the Adi-Dravidar Colony formed in Survey No.170/4A, Manathattai Village, Kulithalai Taluk, Karur District.

O R D E R
Challenging the proceedings dated 02.11.2011 passed by the fifth respondent, the present writ petition has been filed.

Citing the counter-affidavit dated 20.08.2020 filed by the fifth respondent/Special Tahsildar (ADW), Kulithalai, Karur, the learned counsel for the petitioner submitted that the fifth respondent, in his counter itself, has averred that the private respondents were originally allotted free house site pattas in Plot Nos. 33 to 40 on the basis of forged documents and that the allotment of plots to the private respondents deserves to be cancelled.

A perusal of the counter-affidavit, more specifically paragraph No. 7, reveals that it is categorically stated by the fifth respondent that the private respondents obtained free house site pattas by furnishing misleading information to the authorities and that they are not eligible to be granted free house site pattas. The relevant paragraph No.7 reads as under:

"7. I submit that in the meanwhile, we have conducted enquiry with the private respondents herein who are the subsequent allottees. At the outcome of such enquiry, we found that they obtained the allotment of house sites from Plot No.33 to 40 by submitting false and misleading information to the authorities. Originally, the private respondents herein are not eligible to get free house site pattas and hence the allotment of plots to the private respondents by the 5th respondent deserves to be cancelled. Further, there is no possibility for allotting alternative land for private respondents herein. Hence, now it is decided by the authorities to cancel the award no.6/91-92 dated 02.11.2011 which is under challenged in this writ petition. In this regard, I have given a written instruction to the Government Advocate, Madurai Bench of Madras High Court vide Na.Ka.A1/340/2020 dated 31.07.2020. This Hon'ble Court may kindly record our submission and close the writ petition."
4. In view of the above, since the authorities have decided to cancel Award No. 6/91-92 dated 02.11.2011, which is impugned herein, nothing survives for further adjudication in the present writ petition. The counter-affidavit filed by the fifth respondent shall form part of this order.
