ORDER

The writ petition is filed challenging the impugned refusal check slip dated 07.04.2026.

When the petitioner presented a sale deed for registration, the same was refused on the ground that the Tahsildar, Thirumayam, had addressed a letter to the Sub-Registrar in November 2024 stating that, since proceedings for transfer of patta are pending in respect of certain survey numbers and patta numbers, no further documents shall be registered in respect of those properties.

At the outset, it is to be noted that the Tahsildar has no authority to suspend the proprietary rights of the petitioner guaranteed under Article 300A of the Constitution of India merely on the ground that patta transfer proceedings are pending. Patta, by itself, does not confer or extinguish title.

4. In any event, as contended by the learned counsel for the petitioner, the petitioner's patta number is 2787, which does not find place in the said letter of the Tahsildar. The letter specifically mentions certain patta numbers for which registration is to be withheld, and the petitioner's patta is not one among them. Page No.2 of 4

5. In view of the above, the impugned refusal check slip cannot be sustained. Accordingly, this writ petition is allowed on the following terms: (i) The impugned refusal check slip dated 07.04.2026 is quashed.

(ii) The petitioner shall re-present the document, and upon such re-presentation, the same shall be registered within a period of one week from the date of re-presentation, if there are no other impediments.
