Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to restrain the 2nd Respondent, their men and agents from entertaining any document for registration pertaining to the property comprised in Survey No.51/3C2, 51/4B to an extent of 22.32 cents situated at Sayalkudi Village, Kadaladi Taluk, Ramanathapuram District, based on the Petitioner dated 14.01.2026 within the time frame stipulated by this Court.

ORDER

The writ petition is filed for Mandamus to restrain the second respondent, their men and agents from entertaining any document for registration pertaining to the property comprised in survey Nos.51/3C2 and 51/4B to an extent of 22.32 cents situated at Sayalkudi Village, Kadaladi Taluk, Ramanathapuram District based on the petitioner's representation dated 14.01.2026.

2.Upon hearing the learned counsel for the petitioner and perusing the materials on record of the Court, it is the case of the petitioner that Civil Court has already decided the issue in favour of the petitioner in O.S.No.66 of 2012 and the same was also confirmed in A.S.No.12 of 2017. In in spite of the same, the third respondent is further presenting document and creating third party rights. Therefore, the petitioner has made the representation.

3.If it is the case of the petitioner that the Civil Court has held in his favour, the petitioner can also register the judgment and decree of the Civil Court before the Sub Registrar. In any event, the petitioner's representation can be treated as an objection and as and when, any document is presented by the third respondent or any other person with reference to the property that is governed by the Civil Court's decree, due notice can be issued to the petitioner and the executant as claimant and an enquiry can be conducted by the first respondent in the manner known to law.
