ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.118 of 2024, for the offence punishable under 1/3

under Section 379 IPC r/w. 21(1) of Mines and Minerals (Development & Regulations) Act 1957, has filed this petition seeking anticipatory bail.

2. The case of the prosecution is that the petitioner was in illegal possession of 40 units of river sand in his house.

3. The learned counsel for the petitioner submits that the sand has been procured in the year 2022 by getting valid permission. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that the petitioner has one previous case similar in nature. Also, he submitted that the petitioner has not produced any materials for valid permission. Hence, he prays for grant of anticipatory bail to the petitioner.

5. Considering the quantity of minerals and also considering the antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
