ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 06.10.2025 for the offences punishable under Sections 329(4), 296(b), 127(2), 309(6), 109, 64 and 351(3) of BNS in Crime No. 142 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, who is the sole accused had trespassed into the house of the defacto complainant, and robbed her covering chain and 1⁄2 sovereign stud, abused her in filthy language, attacked her with iron box causing injuries on her cheek, hand and rapped and criminally intimidated her.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case. He has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been arrested and remanded to judicial custody on 06.10.2025. Hence, he prays to grant bail to the petitioner.

The learned Additional Public Prosecutor appearing for the respondent police submitted that this is a crime in which the petitioner emboldened entered into the house belonging to the defacto complainant, who was aged about 67 years old, robbed her of a chain and halfsovereign stud, attacked her with an iron box causing injuries and pain, burned her cheek with the iron box, raped her, and criminally intimidated her. The case culminated in laying charge sheet in SC No.958 of 2025 before the Additional Sessions Judge, Mahila Court, Madurai.

5. Heard the learned counsel on either side and carefully perused the materials placed before this Court.

6. It is also brought to my attention that while he was taken to custody and was remanded, he had escaped from the custody, for which separate criminal case has been registered as against him.

7. Considering the gravity of the offence involved, this bail petition is liable to be dismissed and is accordingly dismissed. Since the final report has already been filed, the learned Additional Sessions Judge, 3/6

Mahila Court, Madurai is directed to take the same on file forthwith and frame the charges and conclude the trial in SC No.958 of 2025 as expeditiously as possible within a period of six months. (L V G J) 24.04.2026 Sm 4/6
