Mr.M.Sakthi Kumar, Government Advocate(Crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.125/2024 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324, 323 and 506(ii) IPC in Crime No.125 of 2024 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that a dispute arose between the defacto 1/3
complainant and accused persons with regard to the arrangements of funeral, in which, the accused persons assaulted the defacto complainant and three others with wooden logs.
3.The learned counsel appearing for the petitioners submits that the petitioners are innocents persons and they did not commit any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl.side) appearing for the respondent Police raises serious objections to grant anticipatory bail to the petitioners by stating that the defacto complainant sustained grievous injury in his head and he is still in hospital.
5.Considering the facts and circumstances of the case and also considering the nature of injury sustained by the defacto complainant, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this criminal original petition is dismissed.
