PRAYER :- To release the petitioner on bail in Spl.SC.No.124/2023 on the file of the Sessions Judge, Principal Special Court for Exclusive Trial of cases under POCSO Act, Madurai ORDER : The Court made the following order :- The respondent police registered a case as against this petitioner in 1/3
Spl.S.C.No.124 of 2023, pending on the file of the Sessions Judge, Principal Special Court for Exclusive Trial of CAses under POCSO Act, Madurai,, and remanded him into judicial custody on 23.03.2023. Therefore, the petitioner has filed this petition seeking bail.
2. The case of the prosecution is that on 22.03.2023, the petitioner has sexually harassed the defacto complainant's child. Hence the case.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been arrested and he is languishing in jail from 23.03.2023. Therefore, he prays for grant of bail.
4. The learned Additional Public Prosecutor appearing for the respondent opposed for grant of bail on the ground that it is the second bail application filed by the petitioner and the petitioner is having one previous cases relating to 376 IPC offence, which he has committed in the State of Kerala. He further submits that the trial has been commenced, seven witnesses have already been examined and the case is posted for cross-examination of witnesses P.W.4 to P.W.6.
5. Considering the facts and circumstances of the case and the stage of trial, this Court is not inclined to grant any relief to the petitioner and the trial Court is directed 2/3
