O R D E R

Heard the learned counsel on either side.

2. The petitioner appears to have obtained two passports one after another. According to him, he had lost his first passport. While so, the first respondent herein had taken the petitioner's second passport. The petitioner wants the same back.

3. When the matter was taken up for hearing, the learned Government Advocate appearing for respondents 2 and 3 clarified that no FIR has been registered against the petitioner herein and that he has not come under the adverse notice.

4. The petitioner categorically states that he had lost his passport and if ever he gets the same, he would voluntarily surrender it to the first respondent. In other words, the petitioner undertakes before this Court that he wants only one passport bearing No.J5650122 dated 18.01.2011. 2/4

5. Recording the said undertaking, I direct the first respondent to hand over the same to the writ petitioner forthwith and without any delay. This writ petition stands allowed. No costs.
