ORDER : The Court made the following order :- The petitioner / A1, who was arrested and remanded to judicial custody on 02.04.2025 for the offences punishable under Sections 191(3), 190,61(2),,126, 103(2),3(5) and 253 of BNS in Crime No.70 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to previous enmity the petitioner along with other accused brutally attacked the deceased with deadly weapons and caused his death. Hence the case.

3. The learned counsel for the petitioner would submit that the respondent police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution. The petitioner has been arrested and remanded to judicial custody on 02.04.2025. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that due to previous enmity the petitioner along with other accused brutally attacked the deceased with deadly weapons and caused his death. He would further submit that it is a case of retaliation 2/4

murder and there are many cases pending against the petitioner. Hence, he opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel on either side and this is a case arising out of retaliation murder and considering the fact that the petitioner has so many previous cases and there is a life threat to the petitioner and considering the gravity of offence and also the fact that this court earlier dismissed the bail application filed by the petitioner and there is no change is circumstances to consider the present petition for bail, this petition stands dismissed.
