PRAYER:

Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus directing the 3rd Respondent to issue the Patta to the Petitioner in respect of the Old Survey No.304/1, New Natham Survey No.554/1 situated at Puthanatham Village, Manapparai Taluk, Trichy District on the basis of the Petitioner's representation dated 05.12.2016 with in a time frame to be stipulated by this Hon'ble Court.

The petitioner seeks for a mandamus directing the 3rd Respondent to issue the Patta to the Petitioner in respect of the Old Survey No.304/1, New Natham Survey No.554/1 situated at Puthanatham Village, Manapparai Taluk, Trichy District on the basis of the Petitioner's representation dated 05.12.2016 with in a time frame to be stipulated by this Hon'ble Court.

2. Heard both sides.

3. Needless to say that it is for the third respondent to consider the said representation after giving opportunity of hearing to the petitioner as well as the rival claimants, if any and pass orders on merits and in accordance with law. https://hcservices.ecourts.gov.in/hcservices/

Therefore, without expressing any view on the claim made by the petitioner, the third respondent is directed to consider the petitioner's representation dated 05.12.2016 and pass orders after giving opportunity of hearing to the petitioner as well as the rival claimants, if any on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.

5.With the above direction, this writ petition is disposed of. No costs.
