Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the order in Na.Ka.No.4956/Aa4/2018, dated 8.3.2021 passed by the third respondent and quash the same and consequently direct the respondents to grant selection Grade/Special Grade pay fixation to the Petitioner in the post of Primary School Headmaster with effect from eligible date, by calculating the Petitioner's service as Secondary School Teacher prior to 1.6.1988 along with further service of Secondary Grade Teacher/Primary School Headmaster and grant the arrears of monetary, revised pensionary benefits within the time limit fixed by this Court.

There is no representation on the side of the Petitioner. The matter is listed before me for the third time. On the last hearing date, ie., on 9.9.2025, the learned counsel for the Petitioner submitted that she has sent a letter by registered post to the Petitioner seeking for further instructions. She also submitted on the last hearing date that she has not received any response from 2/6
the Petitioner as on that date. On that ground, a short accommodation was sought for by the learned counsel for the Petitioner. On the request of the learned counsel for the Petitioner, the matter was adjourned for hearing today. 2.The learned Special Government Pleader appearing for the respondents on the last hearing date as well as today, submits that the issue on hand is covered by the decision of the Full Bench, dated 9.12.2016 passed in Review Application No.227 of 2015, wherein, it has been made clear by the Full Bench of this Court that the benefits granted to the Petitioners in the said Full Bench decision cannot be extended to the parties who file fresh Writ Petitions after 9.12.2016. Therefore, the Writ Petition is not maintainable. Since there is no representation on the side of the Petitioner, the arguments advanced by the learned Special Government Pleader appearing for the respondents has to be accepted by this Court.
3.Accordingly, the Writ Petition is dismissed as not maintainable in view of the deadline fixed by the Full Bench of this Court by its decision, dated 9.12.2016 passed in Review Application No.227 of 2015, dated 9.12.2016. No costs. 23.09.2025 3/6
