Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to provide petitioner the loan account closed certificate by receiving the loan amount along with interest and cost of Rs.5,19,000/- according to the order passed by the Hon'ble Principal Sub-Judge, Madurai in O.S.No. 425/2011 dated 31.10.2022 based on the petitioner's representations dated 01.12.2022 in person and 07.05.2023 within the time limit that may be stipulated by this Court.

ORDER

Heard the learned counsel on either side.

2. The petitioner had availed educational loan for his daughter. A default was committed. The Bank therefore, filed a suit for recovering the amount. The suit was decreed. The petitioner now comes forward to settle the entire loan liability. All that he wants is only closure certificate. It appears that the respondents were reluctant to receive the demand draft from the petitioner. That led to the filing of the writ petition.

3. I permit the petitioner to approach the second respondent. The second respondent is directed to accept the demand draft to be submitted by the petitioner. The petitioner is ready to pay the entire dues. The petitioner shall also give an application for closure certificate. The second respondent will forward the same to the concerned authority and

give a disposal to the petitioner's request within a period of four weeks thereafter.

4. This Writ Petition is disposed of with the above direction. No costs.
