ORDER

The present Writ Petition has been filed for issuance of a Writ of Certiorari to quash the impugned order of the 1st respondent in No. 29302/U5/2023 dated 18-03-2024 and the impugned order of the 2nd respondent in Na.Ka.No.3133/A3/2023 dated 22-06-2023.

2. The learned counsel appearing for the petitioners submitted already appeal suit in A.S.No. 43 of 2023 is pending before the Principal Sub Court, Thanjavur.

3. It is seen from the records that the present impugned order was passed under Section 77A of the Registration Act. The respondents are not having right or jurisdiction to entertain any claim under Section 77A of the Registration Act, as it has been held to be ultra vires. 2/4

3. Accordingly, this writ petition is allowed. The impugned orders dated 18-03-2024 and dated 22-06-2023, are hereby quashed. The parties are at liberty to agitate their rights in pending appeal. There shall be no order as to costs.
