Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to issue patta to petitioner's properties situated in Survey No/69/1 having extent of 20 cents on the northern side out of 44 cents, in Survey No.69/1 having extent of 25 cents out of 44 cents on the southern side, in Resurvey No.104/1, Patta No.326, in UDR Survey No.104/1 having extent of 40 cents on the southern side out of Ares 0.48.5 I.e., Acre 1 cent 20, in Resurvey No.70/1B2, Patta Nos.326,327, in UDR Survey No.70/1B2 having extent of 37 cents on the eastern side out of Ares 0.49.0 i.e., Acre 1 cent 18, in Resurvey No.70/1B1, patta No.338, in UDR Survey No.70/1B1 having extent of 9 cents on the southern side out of Ares 0.11.0 i.e., cent 27, in Resurvey No.

110/1 having extent of 1 cent on the eastern side out of 3 cents, Resurvey No.110/1 in which Plot No.11 having extent of 2 cents at Poikaraipatti, Kallanthiri, Madurai District in the light of the petitioner's representation dated 18.08.2020 and 19.07.2021 respectively within stipulated time fixed by this Court.

The petitioner seeks a mutation of patta in respect of the properties in several survey numbers as described in the writ petition. 2.The petitioner claims title to the said properties by way of a settlement deed executed by his father on 12.08.2020 bearing Document No.1235/2020. The pattas issued in his father's name are enclosed in the typed set of papers. It is stated that in spite of submitting an application on 18.08.2020 seeking patta by remitting the requisite fees, no action has been taken thereon.

3.Mr.R.Baskaran, learned counsel for the State, accepts notice on behalf of both the respondents and submits that the petitioner's application may be directed to be disposed of on merits. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.13521 of 2021 4.Accordingly, without going into the merits of the matter, the second respondent herein is directed to consider and dispose of the petitioner's application for patta dated 18.08.2020 within a period of three months from the date of receipt of a copy of this order. Before passing such order, the petitioner and any others who would be affected by such decision shall be provided a reasonable opportunity. 5.W.P(MD).No.13521 of 2021 is disposed of on these terms without any order as to costs.
