Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to initiate contempt proceedings against the contemnor / Respondent and punish him for the willful disobedience against the order in W.P.Crl.(MD).No.348 of 2026 dated 23-01-2026.

ORDER

The writ petition was filed for issuance of Mandamus, to take appropriate action by considering the petitioner's representation. After hearing the submissions, this Court directed the second respondent Assistant Commissioner of Police to consider the petitioner's complaint and pass orders and if any cognizable offence is made out, appropriate actions shall be taken. The respondent has taken the complaint on file and passed an order dated 15.06.2026 wherein it is stated that it is dispute between the https://www.mhc.tn.gov.in/judis

landlord and tenant, therefore, no cognizable offence is made out. This Court is accepting the said order.

2.At this juncture, the Learned Counsel appearing for the petitioner submitted that the erstwhile Inspector of Police had snatched the keys from the tenant and handed over to the landlord. When there is a landlord tenant dispute, if the tenant is aggrieved by any action of the landlord, he is at liberty to approach the competent Rent Control Court and the remedy lies before the said Court and not before the police.
