PRAYER :

For Bail in Crime No.759 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 17.06.2021 for the offences punishable under Sections 147, 148, 118, 302 and 120B IPC and Section 25(1B)(b) of the Arms Act, 1959 in Crime No.759 of 2021 on the file of the respondent police, seeks bail. 2.The learned counsel appearing for the petitioner submits that the petitioner is a physically challenged person with 60% disability and despite the same, he has been implicated in six cases. The learned counsel further submits that the petitioner is languishing in jail from 17.06.2021.

3.Per contra, the learned Government Advocate (Crl. Side) submits that this is a case of retaliation murder and on both sides, there are several murders. This petitioner, apart from this case, is involved in five cases, the details of which are as follows: a)Thiruneelakudi Police Station - Cr.No.159/16 under Sections 397 and 394 IPC.

b)TVMR PS Cr.No.145/18, under Section 399 IPC amd 3(1) of TNPPDL Act https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.10331 of 2021 c)TVMR PS Cr.No.1175/20, under Section 294(b), 386 and 506(ii) IPC.

d)TVMR PS Cr.No.1624/20 under Section 392 IPC. e)TVMR PS Cr.No.759/21, under Sections 147, 148, 188 r/w. 302, 120(b), r/w. 302 IPC and 25(1B)(b) of the Arms Act. 4.The learned Government Advocate (Crl. Side) further submits that rowdy history sheet has been opened against this petitioner in Rowdy H.S.No.597/13 dated 28.08.2013.

5.Considering the nature of offences and the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
