PRAYER :Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, directing the 1st respondent to appoint an investigation officer not below the rank of Deputy Superintendent of Police to enquire the complaint given by the petitioner dated 10.04.2024 and the representation dated 16.04.2024.

The petitioner with a grievance that his complaint dated, 10.04.2024 has not been acted upon by the respondents has approached this Court.

2.The case of the petitioner is that the petitioner is working at Chennai and he left his Car in his residence situated at Solavandan. According to the petitioner, one Kumaresan from Genguvarpatti and Sankar from Solavandan deceived the petitioner's father and pledged his car to one Pandiarajan for Rs.50,000/-. Once 2/5

he came to know the fact, he approached those persons for redemption of the car. However, they are dragging the issue with an intention to grab the car. Therefore, the petitioner has submitted a complaint dated 10.04.2024 before the respondent. However, the respondents have not acted upon the petitioner's complaint. Hence, the petitioner is before this Court.

3.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents and submits that the complaint given by the petitioner has been registered in CSR No. 170 of 2024 on 10.04.2024.

4.The respondent police is not supposed to keep the petition enquiry pending for more than fifteen days in normal cases and six weeks in exceptional cases. In the event, if any cognizable offence is made out, the respondent ought to register a complaint and take initiative on it. Therefore, this writ petition is disposed of with a direction to the respondent police to take a decision on the complaint 3/5

of the petitioner, dated 10.04.2024, within a period of two weeks from the date of receipt of a copy of this order. No costs. 20.06.2024 NCC : Yes / No.
