PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 3 and 6 to take action against the respondents 7 to 9 based on the representation dated 27.02.2022 within the time frame fixed by this Court.

O R D E R

This Writ Petition has been filed for issuing a direction to the respondents 3 and 6 to take action against the respondents 7 to 9 based on the representation, dated 27.02.2022 within the time frame fixed by this Court.

2. According to the petitioner, the respondents 7 to 9 dismantled and caused damage to the existing pathway used by the public. Hence, objecting the same, the petitioner has sent a representation to the second respondent and in turn the 2nd respondent forwarded the same to the 6th respondent. But, no action has been taken so far.

3. The learned Government Advocate (Crl. Side) appearing for the respondents police would submit that the petitioner appeared before the Sub Inspector of Police, Aviyur Police Station and accepted to give complaint to the PWD with regard to the same. With regard to the damage caused in existing pathway, enquiry has to be conducted by the respondent police.

4. Recording the same, the 6th respondent is hereby directed to conduct the enquiry on the complaint given by the petitioner, dated 27.01.2022 and take action against the persons, who dismantled and damaged the existing pathway unlawfully, and complete the same within a period of two weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
