Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent to process the application, dated 23.12.2021 bearing Can No. 13322021116482252 and Application NO.2021/0105//22/138752 for sub division of the land measuring 33.25 cents out of 48 cents in S.No.54/8 and to issue separate patta to the Petitioner for the land measuring 33.25 cents.

ORDER
The Writ Petition has been filed seeking issuance of a Writ of
Mandamus directing the first respondent to process the application, dated 23.12.2021 bearing Can No.13322021116482252 and Application NO. 2021/0105//22/138752 for sub-division of the land measuring 33.25 cents out of 48 cents in S.No.54/8 and to issue separate patta to the Petitioner for the land measuring 33.25 cents. 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court.
3.When the matter is taken up for hearing today, the learned Government Advocate appearing for the first respondent produced a communication of the first respondent, dated 26.11.2022 stating that there is difference between the available land on ground and the extent of land mentioned in the sale deed and hence the claim of the Petitioner in the Writ Petition is rejected.
4.However, considering the request the request made by the Writ Petitioner, this Court, without going into the merits of the matter, directs the first respondent to consider the representation of the Petitioner submitted in this regard on 23.12.2021 and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to all the parties concerned, within a period of 8 weeks from the date of receipt of a copy of this order.The Petitioner is also directed to
produce the relevant documents in support of his claim made in the Writ Petition, for appropriate and necessary relief, as sought for in the Writ Petition, if so advised.
5.With the above directions, the Writ Petition stands disposed of. Nocosts.
