ORDER

The Writ Petition is filed for issuance of a Writ of Mandamus, directing the respondent to receive the Mandagapadi fee from the petitioner Trust and Page No.1 of 4

permit the Trust to conduct the Mandagapadi in front of the property situated at Door No.12, Tallakulam Village, Madurai, near Arulmigu Prasanna Venkatachalapathi Temple.

2. When the matter came up for admission, the learned Standing Counsel appearing on behalf of the temple submitted that the Mandagapadi cannot be conducted on the road. The Mandapam, where the Mandagapadi used to take place, is now in the possession of third parties. In any event, an enquiry would be conducted.

3. In reply thereof, the learned counsel for the petitioner submitted that the petitioner's right has already been crystallized in A.S.(MD)No.163 of 2018, etc., batch. When the Civil Court has recognized the rights of the parties, the same ought not to be denied merely on the ground of non-availability of space.

4. I have considered the rival submissions and perused the materials available on record.

5. If, as per the usual practice, the Mandagapadi cannot be conducted on the road, appropriate temporary arrangements may be made at a suitable place so Page No.2 of 4

that, the same can be performed without affecting the due respect to be paid to the deity and in accordance with tradition. It is stated that the temple would conduct an enquiry and pass appropriate orders well before 24.04.2026.

6. The learned Standing Counsel for the temple as well as the learned counsel for the petitioner shall inform the respective parties, and without waiting for a copy of this order, the exercise shall be carried out and final orders shall be passed.
