ORDER

This Petition is filed to condone the delay of 505 days in filing the above appeal.

2. Heard the learned counsel appearing for the petitioner and perused the materials placed before this Court.

3. The learned counsel appearing for the 2nd respondent has no objection to allow this petition on condition that the petitioner is not entitled for interest for the default period. 4.Therefore, for the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, the delay is condoned and this Petition is allowed on condition that the petitioner is not entitled for interest for the default period alone. 5.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list it for admission in the usual course.
