Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to disburse the salary to the petitioner for his service after retirement from 29.09.2011 to 31.05.2013, as per Rule 44 of the Tamilnadu Pension Rules, 1978, by considering his representation dated 28.10.2017, within the time period stipulated by this Court. The petitioner seeks to issue a Writ of Mandamus, directing the respondents to disburse the salary to the petitioner for his service after retirement from 29.09.2011 to 31.05.2013, as per Rule 44 of the Tamilnadu Pension Rules, 1978, by considering his representation, dated 28.10.2017.
2.K.Mu.Muthu, the learned Additional Government Pleader takes notice for the respondents.
3.The learned counsel for the petitioner submitted that it would suffice if the representation of the petitioner dated 28.10.2017 is disposed of, in accordance with law, within a time frame to be fixed by this Court.
4.In view of the limited scope of the prayer, without going into the merits of the matter, the respondents are directed to consider the representation of the petitioner, dated 28.10.2017 in accordance with law, after giving notice to the interested parties, if any, and pass appropriate orders within a period of two months https://hcservices.ecourts.gov.in/hcservices/
from the date of receipt of a copy of this order, if there are no legal impediments.
5.With the above direction, the Writ Petition stands disposed of. No costs.
