O R D E R

The Petitioner herein seeks a direction to the respondents to issue patta in favour of the Petitioner in respect of the property situate in (*)Survey No.328/18, S.Pudur Village, Tiruvidaimaruthur Taluk, Thanjavur District. 1/4

2.According to the Petitioner, the subject property is the ancestral property of his father and the same was bequeathed in his favour by his father under registered Will, dated 26.03.2019. It is further stated that the subject property was wrongly classified as ''kept pending'' in Natham Nilavari Thittam. Therefore the Petitioner submitted a representation on 7.11.2023 before the first respondent seeking issuance of exclusive patta in his favour based on the documents submitted by him. Since the same was not considered, the Petitioner is before this Court by filing the present Writ Petition.

3.M/s.K.Malathi, learned Additional Government Pleader who takes notice for the respondents submit that in Natham Nilavari Thitttam, the subject property has been classified as Sarkar Manai.Therefore the representation of the Petitioner cannot be considered by the first respondent and the competent authority is the Commissioner of Land Administration,Chennai.

4.In view of the same, the first respondent is directed to forward the representation of the Petitioner, dated 7.11.2023 to the Commissioner of Land Administration within a period of two weeks from the date of receipt of a copy of this order.The said authority shall consider the abovesaid representation of the Petitioner forwarded to him, on its own merits within a further period of 12 weeks from the date of receipt of the representation from the first respondent. 2/4
