CMP(MD).No. 5807 of 2026 in SA(MD).No.46 of 2017 P.B. BALAJI, J., This petition has been filed seeking restoration of the Second Appeal in S.A.(MD) No. 46 of 2017, which was dismissed for default on 12.03.2026, by setting aside the said order of dismissal.

2. The learned counsel appearing for the respondents fairly submitted that he has no objection to the restoration of the Second Appeal, as it was dismissed for non-prosecution only on 12.03.2026 and the present application has been filed immediately within a period of 30 days.

3. I have also gone through the affidavit filed by the first petitioner in support of the application for restoration and am satisfied that the petitioner has made out sufficient cause.

4. Hence, this petition is allowed, and the Registry is directed to restore the Second Appeal to file and list the same for final hearing on 24.06.2026.
