Respondents/Respondents Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the Inspector of Police, Thiruppalai Police Station, Madurai city not to force the petitioners to part with a sum of Rs.2,00,000/- to the third respondent which amount is said to be rental due in connection with the petitioners' occupation in the house in D.No.2/1155, Santhanam Nagar, 3rd Street, Kannanendal, Madurai - 14, which is the subject matter of a civil suit in O.S.No.174 of 2020 pending on the file of the learned District Munsif, Melur, Madurai District. For Petitioners : Mr.R.Kannan For Respondents : Mr.R.M.Anbunithi, Additional Public Prosecutor for R1 & R2.
ORDER
This petition is filed seeking a direction to the respondent not to force the petitioners to part with a sum of Rs.2,00,000/- to the third respondent, which according to the respondent, the amount is due to be paid by the petitioner on the basis of the rental agreement.
2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that the third respondent is a landlord of the petitioner. He gave a complaint, which is registered in CSR No.502 of 2021 and during the course of enquiry, there was a compromise between the parties, by which, the petitioner https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.11064 of 2021 undertook to pay the balance rent amount as well as to vacate the premises. Based upon the undertaking, it came to be closed on 07.07.2021.
3. Recording the submission made by the learned Additional Public Prosecutor that enquiry was closed, nothing survives for further consideration or direction in this petition. Accordingly, this Criminal Original Petition is disposed of. The parties are at liberty to approach the concerned Civil Forum for their remedy, if any issue arises in future.
