Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the respondent in his proceedings dated 30.05.2017 and quash the same as illegal and consequently directing the respondent to grant permission and afford protection for conducting the Kabadi Tournament scheduled between on 09.06.2017 from 6.00 am to 10 pm and for usage of mike set during the said Tournament scheduled at Pillaiyar Kovil, Mela Sriyanthur Village, Srivaikundam Taluk, Thoothukudi District. [Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the proceedings dated 30.05.2017 passed by the respondent and quash the same, by way of issuing a Writ of Certiorarified Mandamus. 2.Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader, has taken notice for the respondent. 3.The learned counsel appearing for the petitioner has contended to the effect that a representation has been given to the respondent for conducting Kabadi Tournament on 09.06.2017, but the respondent even without assigning any proper reason has rejected the same. Under the said circumstances, this petition has been filed for getting the relief sought therein. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Additional Government Pleader appearing for the respondent has represented to the effect that the petitioner without furnishing necessary particulars sought permission for conducting Kabadi Tournament on 09.06.2017 and the respondent, after considering the lapses on the part of the petitioner, has rightly rejected the representation and therefore the impugned order passed by the respondent need not be quashed. 5.It is seen from the records that the petitioner has given a representation for getting necessary permission with regard to Kabadi Tournament to be held on 09.06.2017. The respondent has rejected the same on the ground that the petitioner has not furnished necessary particulars.
6.Considering the aforesaid circumstances, this Court is inclined to pass the following order.
7.In fine, this Writ Petition is allowed in part without costs and the proceedings dated 30.05.2017 passed by the respondent is quashed. However, the petitioner is directed to furnish all particulars to the respondent within a period of two days and after getting all necessary particulars, the respondent is directed to dispose of the representation afresh.
