ORDER : The Court made the following order :- The petitioners, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.80 of 2024, for the offence under Section 269 IPC and Sections 6(b) and 24(1) of Cigarette and other Tobacco Act, 2003, have filed this petition seeking anticipatory bail.

2. The case of the prosecution is that the petitioners were found in possession of banned tobacco products.

3. The learned counsel appearing for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. However, this case has been foisted against the petitioners. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) opposes for grant of anticipatory bail on the ground that the first petitioner is having four previous cases and the second petitioner is having three previous cases. 2/3

5. Considering the nature of offence and also considering the antecedent of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
