PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Mandamus, to direct the respondents to disburse the balance amount of pension arrears of Rs.90,255/- and with the 6% interest for the amount for the delay payment of pension difference amount for 5 months in Rs.24,364/- 1/5

along with the 8% interest for provident amount of Rs.1,61,544. In a total amount of Rs.2,76,168/- and also recovered the amount of ERPS (Employees Retirement Pension Scheme) amount for the six years from 01.09.1998 to till the date of retirement on 30.09.2018 and the contribution of the Medical, Engineering & Polytechnic College for Rs.10,000/- along with 6% interest.

The petitioner, a retired Senior Assistant Engineer of the respondent State Express Transport Corporation, (Tamil Nadu) Ltd has filed this writ petition for a Mandamus, to direct the respondents to disburse the balance amount of pension arrears of Rs.90,255/- with 6% interest for the delayed payment of pension and in total a sum of Rs.2,76,168/- to him within a stipulated time. 2.Today (18.12.2024), when this writ petition is taken up for hearing, the learned standing counsel for the respondents submits that the eligible amount of Rs.1,04,000/- has already been paid by the respondent Corporation to the petitioner.

3.The learned counsel for the petitioner claims that this writ petition has been filed that the petitioner is entitled to a sum of Rs.2,76,000/-. However, he was paid with a sum of Rs.1,04,000/- only. 4.Considering the rival submissions made, this writ petition is disposed of with a direction to the respondents to furnish the details with regard to the amount arrived by the respondent Corporation for payment of the retirement benefits to this petitioner within a period of four weeks. In the event, if the calculation has not been made properly, it is always open to the petitioner to challenge the same in the manner known to law. No costs.
