Heard both sides.
2. The petitioner is a permanent resident of Godalvavi Village in Dindigul West Taluk. He alleges that in survey Nos.324 and 326, 2/4
3 W.P.(MD)NO.9347 OF 2019 there are encroachments. Since the authorities did not take any action to remove the same, this writ petition came to be filed.
3. When the matter was taken up for final disposal, it is admitted by the learned Special Government Pleader that both the survey numbers have been classified as water bodies. It is admitted that the private respondents filed civil suit to forbear the authorities from evicting them. Though the suit was dismissed in the year 2023 itself, we have our own doubts about the very maintainability of the suit.
4. Be that as it may, we direct respondents 2 and 3 to take effective action so that the encroachments are cleared. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. The respondents shall put all the encroachers on notice and adhere to due process of law before taking action. This writ petition stands disposed of. No costs.
