3.The Special Tahsildhar, Town Survey settlement Scheme, Theni - Allinagaram : Respondents PRAYER: Petition filed under Article 226 of the Constitution of India for the issue of a Writ of Certiorarified Mandamus calling for the records relating with the order in Na.Ka.No.628/2016/A6, Dated 29.07.2016 issued by the 2nd respondent and quash the same as it is arbitrary and illegal and in consequence direct the respondents to issue a patta in favour of the petitioner, for his property measuring 10 cents out 89 1⁄2 cents in the total area of 3 Acre 58 cents, comprised in Survye No.2301 in Theni Allinagaram village, in Theni District, after subdividing the same as according to his sale deed dated 18.12.1997.

Learned counsel counsel appearing for the petitioner seeks permission of this Court to withdraw this writ petition with liberty to file a fresh writ petition by challenging the earlier order passed in the year 1998 itself, as the said order is not at all communicated to the petitioner at any point of time. 2.He has also made an endorsement to that effect. 3.Recording the said endorsement, this writ petition is dismissed as withdrawn by granting such liberty.
