Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents 1 to 4 herein to remove the encroachments made in the Public Road comprised in Survey No.658/1C14, situated at Kadambanoor Village, Ezhuvanampatti, Nilakkottai Taluk, Dindigul District made by the respondents 5 and 6 herein by considering the petitioner's representation dated 24.05.2017.

O R D E R

*********** [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner has filed the instant writ petition seeking a direction to the respondents 1 to 4 to remove the encroachments made in the Public Road comprised in Survey No.658/1C14, situated at Kadambanoor Village, Ezhuvanampatti, Nilakkottai Taluk, Dindigul District by the respondents 5 and 6 by considering his representation dated 24.05.2017.

2. The petitioner submitted a representation before the Tahsildar, Nilakkottai on 24.05.2017 requesting him to remove the encroachments made by the respondents 5 and 6. Since follow up action was not taken by the Tahsildar, the petitioner has come forward with this writ petition.

3. We have heard the learned Counsel appearing for the petitioner; the learned Additional Government Pleader appearing for the respondents 1, 2 and 4 and the learned Counsel appearing for the respondents 3, 5 and 6.

4. We direct the second respondent to consider and dispose of the representation dated 24.05.2017, submitted by the petitioner, on merits and as per law, after issuing notice to the respondents 5 and 6. Such exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
