To suspend the sentence imposed on the Petitioner/Appellant/Accused No. 2 namely Senthil @ Senthilkumar, S/o. Subbaiah passed by the III Additional District and Sessions Court, Tirunelveli in S.C. No. 143 of 2021 dt. 28.04.2025 and to enlarge the petitioner on bail pending disposal of the Criminal Appeal.
ORDER
(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking for suspension of sentence imposed on the petitioner in the judgment passed by the III Additional District and Sessions Court, Tirunelveli in S.C. No. 143 of 2021 dated 28.04.2025 and to enlarge the petitioner on bail.
2. Heard the learned counsel on either side.
3. It is seen from records that the petitioner earlier filed a petition seeking for suspension of sentence and the same has been dismissed by this Court. The present petition has been filed on the ground that the puberty function of the petitioner's daughter has been fixed on 23.04.2026 and the petitioner wants to attend that function.
4. The learned Additional Public Prosecutor on instructions submitted that the suspension of sentence petition filed by the petitioner was dismissed earlier and there is likelihood of a retaliation, if the petitioner is let out on interim bail.
5. The learned counsel appearing for the petitioner submitted that the function has now been refixed on 25.04.2026 and that this Court may consider granting the petitioner three days interim bail.
6. Taking into consideration the facts and circumstances of the case and considering the submissions made on either side and taking note of the fact that the puberty function involves some sentiment for the father, we are inclined to grant interim bail to the petitioner.
7. In view of the same, the petitioner is granted interim bail from 24.04.2026 at 05.00 p.m., and he shall report before the Superintendent of Prisons, Central Prison, Palayamkottai on 25.04.2026 at 05.00 p.m. The petitioner shall execute a personal bond for a sum of Rs.10,000/- (Rupees
Ten Thousand only) before the Superintendent of Prison, Central Prison, Palayamkottai.
8. This petition is disposed of in the above terms.
