ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ of mandamus has been instituted to direct the respondents 1 to 3 to take action regarding cancellation of license against the fourth and fifth respondents for issuing first year mark sheet and provisional certificate of the petitioner.

2. The petitioner secured admission to undergo B.Tech (Mechanical Engineering) course at Saveetha University, Chennai. Due to personal reasons, he submitted an application seeking transfer to the fifth respondent University. The transfer was granted by the authorities to undergo B.Tech course from the second year onwards. The petitioner was admitted in the fifth respondent University for the academic year 2014 - 2015 in II year as per Credit Transfer System and his registration No.7614201 M01. The petitioner undergone the course. 3/6

3. The respondents would submit that the transfer credit of the petitioner at the time of his admission in the fifth respondent University is 23. At PRIST Deemed University, he scored the credit of 175 and his total credit is 198. However, the petitioner has to score the total credit of 233 to get pass in the course. Thus, he has to complete balance credit of 35 by appearing the examinations for papers in which he failed for getting provisional as well as degree certificates.

4. Since the terms and conditions for transfer was admitted by the student, he has to necessarily pass all the required papers for securing credit of 233 to get pass in the course. Courts in exercise of powers and judicial review cannot interfere in the scheme of education for issuance of degree certificate.

5. In the present case, on account of transfer from Saveetha University to the fifth respondent University, the petitioner has faced certain trouble and now he has to necessarily secure the balance credit of 35 by appearing in examinations.

6. With the above observations, this writ petition stands dismissed. No costs.
