The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 49 days in filing the appeal against the award, dated 25.11.2024 made in M.C.O.P.No.151 of 2023 on the file of the Motor Accident Claims Tribunal, Special Sub Court, Thanjavur.
2. Paper publication effected for R2. Service is sufficient. No representation for the second respondent. It is seen from the records that the first respondent has remained ex parte.
3. Heard the learned counsel for the petitioner and also perused the records.
4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
