Respondents Prayer: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to take action against the 2nd respondent for his misbehaviour in enquiring into the petitioner's representation, dated 30.03.2017 and to transfer the same to the District Crime Branch, Tirunelveli.

ORDER

It is seen that the this petitioner gave a complaint against one Mariammal, based on which a petition enquiry was conducted in CSR No.435 of 2016. Similarly Mariammal gave a complaint against this petitioner, based on which a petition enquiry was conducted in C.S.R.No.439 of 2016. In both the CSRs, enquiry was completed and they were closed on 21.12.2016 directing the parties to work out their remedies before the appropriate forum. While so, the petitioner herein gave another complaint against Mariammal and others on 30.03.2017 and filed W.P.(MD).No.8351 of 2017, before this Court. This Court vide order, dated 28.04.2017, directed the police to conduct enquiry on the complaint, dated 30/3/2017. Pursuant to the directions issued by this Court a fresh enquiry was conducted and the same was closed on 26.05.2017. Now the petitioner has made allegation that the Deputy Superintendent of Police has slapped him during enquiry and therefore, the petitioner has given a representation dated 30.03.2017 and has come up with the above prayer.

2. In the considered opinion of this Court, facts of this case disclose that this petitioner has been attempting to force Mariammal to marry him, but she has spurned his offer. Aggrieved by that, this petitioner has alleged that Mariammal and her family members owing money and has given complaint against them. The allegations made by the petitioner does not inspire the confidence of this Court for issuing a direction as prayed for in the writ petition.

3. In the result, the writ petition is devoid of merits and the same is dismissed. No costs.
