PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the impugned orders passed by the 2nd respondent dated 02.09.2022 under Na.Ka.No.1780/ ThaPi/ 2022 by confirming the impugned order passed by the 3rd respondent dated 02.02.2022 under Mu.Mu.No.5460/Aa2/ 2021 as far as quashing the power deeds under Doc.Nos.187/2005, 188/2005, 189/2005, 257/2005, 206/2005, 881/2007, 145/2009, 655/2008 and sale deeds under Doc.Nos.1382/2007 and 3458/2010 and to quash the same as illegal by following judgment of this Court in M.Kathirvel Vs. The Inspector General of Registration and the same is reported in 2024 (5) MLJ 107.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned orders passed by the 2nd respondent dated 02.09.2022 under Na.Ka.No.1780/ ThaPi/ 2022 by confirming the impugned order passed by the 3rd respondent dated 02.02.2022 under Mu.Mu.No.5460/Aa2/ 2021 as far as quashing the power deeds under Doc.Nos.187/2005, 188/2005, 189/2005, 257/2005, 206/2005, 881/2007, 145/2009, 655/2008 and sale deeds under Doc.Nos.1382/2007 and 3458/2010 as illegal by following judgment of this Court in M.Kathirvel Vs. The Inspector General of Registration and the same is reported in 2024 (5) MLJ 107.

2.The impugned order is passed under Section 77A. The said Section 77A is declared as illegal. Therefore, the impugned order passed by the 2nd respondent is non est in the eye of law. Hence, the impugned order is quashed. 3.Further, it is seen that the 5th respondent has already filed the suit and the same was dismissed, ie., ended in favour of the petitioner. Against which and appeal was preferred and the appeal was dismissed for non prosecution. The said statements are recorded.
4.With the above observations, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
