ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 392 of IPC in Crime No.458 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is running a Hotel. On knowing that the defacto complainant will return to home alone, the petitioner along with two others waylaid him and snatched away the sales amount along with his mobile phone. Hence, the Complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he is falsely implicated in this case.

4. The learned Government Advocate (Criminal Side), on instructions, would submit that the second accused was arrested, a sum of Rs.5,000/- has been recovered and the mobile phone is yet to be recovered.

5. Since some of the articles are yet to be recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
